Terms of Service

The Short Version
SailScore is a sailing event platform. You can score races, register for events, manage boats, and view results. Race results are public — that's how sailing works. Don't abuse the platform, don't fake your data, and don't scrape without permission. Support staff can only access your account if you explicitly opt in. We can suspend accounts that break these rules. Disputes go to arbitration. Our liability is capped.
1. Agreement to Terms
By creating an account or using SailScore (the "Service"), you agree to these Terms. If you're using the Service for a yacht club, class association, or other organization, you represent that you have authority to bind that organization.
You must be:
- At least 18 years old, or
- At least 13 with a parent or guardian's consent and supervision.
If you don't agree to these Terms, don't use the Service.
2. What SailScore Does
SailScore provides:

3. Your Account
3.1 Registration
You must register to access most features. You agree to provide accurate, current, and complete information and to keep it updated.
3.2 Security
You are responsible for your account credentials and all activity under your account. If you suspect unauthorized access, notify us immediately at support@sailscore.com.
3.3 Roles
The Service has multiple roles — competitors, event staff, organization administrators, and platform administrators. Elevated roles carry additional responsibilities and are granted at the discretion of SailScore or the applicable organizing authority.
3.4 Boat Ownership Claims
You may claim ownership of boats on the platform. Claims are subject to admin review. Fraudulent ownership claims are grounds for immediate account termination.
3.5 Support Access (Account Impersonation)
SailScore administrators have the technical ability to temporarily access your account to provide support and troubleshoot issues ("Support Access"). This feature requires your explicit opt-in consent.
- Disabled by default. No administrator can access your account through Support Access unless you enable it.
- You control it. Enable or disable Support Access at any time via Account Settings → Privacy → "Allow Support Access."
- Time-limited. Each session expires automatically (maximum 2 hours).
- Fully audited. Every Support Access session — and every action taken during it — is logged with the administrator's identity, timestamp, and IP address. You can review your complete Support Access history in Account Settings → Privacy → Support Access Log.
- You'll be notified. You will receive a notification when a Support Access session begins on your account.
- Not your responsibility. Actions taken during Support Access are attributed to the administrator in our audit log, not to you.

3.6 Account Deletion
You may delete your account anytime through Dashboard → Account Settings. Upon deletion, your personal data is handled per our Privacy Policy. Race results may be retained in anonymized form as part of the permanent racing record.
4. Events, Registrations, and Payments
4.1 Event Rules
When you register for an event, you agree to that event's Notice of Race (NOR), Sailing Instructions (SIs), and any applicable rules of the organizing authority. Registration may require crew info, safety declarations, measurement data, and waiver acceptance.
4.2 Payments
Entry fees are processed through Stripe. By paying, you also agree to Stripe's Terms. All fees are displayed in the applicable currency at checkout.
4.3 Refunds
Refund policies are set by the event organizer (yacht club or class association), not by SailScore. Contact the event organizer directly for refund requests. SailScore platform fees, where applicable, are non-refundable.
5. Race Results and Public Data
5.1 Publication
Your name, sail number, boat name, boat class, and finishing positions will be published on the Service and shared with governing bodies, media, and other third parties. This is an inherent and essential part of competitive sailing. You acknowledge this when you register for a scored event.
5.2 Accuracy
While we strive for scoring accuracy, the official results of any event are determined by the race committee and protest committee per the Racing Rules of Sailing. Results on the Service are informational and may be corrected.
5.3 Scraped Data
The Service aggregates publicly available sailing data from third-party platforms. If data about you is inaccurate or you want it removed, contact us at support@sailscore.com.
5.4 Protests
Scoring disputes and protests are governed by the Racing Rules of Sailing and the event's Sailing Instructions. The Service may facilitate communication but does not replace the formal protest process.
6. Rules of Conduct
6.1 You Agree Not To:
- Use the Service for any unlawful purpose.
- Impersonate another person or entity.
- Falsify boat ratings, measurement data, ownership claims, or race declarations.
- Interfere with or disrupt the Service or its infrastructure.
- Upload malicious code, viruses, or harmful software.
- Scrape, crawl, or use automated tools to extract data without our written consent.
- Circumvent or manipulate scoring systems or race results.
- Harass, threaten, or abuse other users.
- Send spam or unsolicited communications through the Service.
- Reverse-engineer, decompile, or derive the source code of the Service.
- Remove or alter proprietary notices on the Service.
6.2 Enforcement
We may remove content, restrict access, or terminate accounts at our sole discretion for violations.
7. Your Content
7.1 Ownership
You retain ownership of content you submit (photos, profile info, comments, etc.). By submitting content, you grant SailScore a non-exclusive, worldwide, royalty-free, sublicensable license to use, display, and distribute it in connection with operating and improving the Service.
7.2 Responsibility
You are responsible for ensuring your content doesn't violate any laws or third-party rights. We may remove content that violates these Terms.
8. Marketplace
8.1 Listings
SailScore may offer a marketplace for buying and selling boats and sailing equipment. Listings are created by users; SailScore does not verify the accuracy of listings, inspect items, or guarantee transactions.
8.2 Transactions
Marketplace transactions are between the buyer and seller. SailScore is not a party to any sale and assumes no liability for the condition, quality, safety, or legality of listed items, the truth of listings, or the ability of sellers to sell or buyers to pay.
8.3 Disputes
Marketplace disputes are between the parties involved. SailScore may assist in communication but is not obligated to mediate or resolve disputes.
9. Intellectual Property
9.1 Our Property
The Service — its design, logos, software, algorithms, scoring engines, and documentation — is SailScore's property, protected by copyright, trademark, and IP laws. You may not copy, modify, distribute, or create derivative works without written permission.
9.2 Racing Rules
References to the Racing Rules of Sailing, PHRF, IRC, ORC, and other systems are the intellectual property of their respective owners (World Sailing, US Sailing, RORC, ORC, etc.) and are used solely for scoring purposes.
9.3 Feedback
If you provide suggestions or feedback about the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free right to use that feedback without obligation to compensate you.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free.
- Scoring calculations or results will be completely accurate.
- Data from third-party sources will be accurate, complete, or current.
- Defects will be corrected in any particular timeframe.
SAILING IS INHERENTLY DANGEROUS. SailScore provides administrative and scoring tools only. We are not responsible for on-water safety, race management decisions, weather conditions, or any incidents during sailing events.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLEET PORTAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.
This applies regardless of the theory of liability (contract, tort, strict liability, or otherwise), even if we've been advised of the possibility of such damages.
Total liability cap: The greater of (a) amounts you paid to SailScore in the 12 months before the claim, or (b) $100 USD.
12. Indemnification
You agree to indemnify and hold harmless SailScore and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your use of the Service.
- Your violation of these Terms or any applicable law.
- Content you submit.
- Fraudulent or misleading information you provide.
- Marketplace transactions you participate in.
13. Dispute Resolution
13.1 Talk to Us First
Before filing anything formal, contact us at support@sailscore.com and try to resolve the matter informally for at least 30 days.
13.2 Binding Arbitration
Disputes not resolved informally will be settled by binding arbitration under the American Arbitration Association's Commercial Arbitration Rules. The arbitration will be conducted in English, and the arbitrator's decision is final.
13.3 Class Action Waiver
You agree to resolve disputes individually. You waive any right to participate in a class action, class arbitration, or representative proceeding.
13.4 Exceptions
Either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.
13.5 Small Claims
Either party may bring qualifying claims in small claims court.
14. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict of law principles. For matters not subject to arbitration, you consent to the exclusive jurisdiction of the federal or state courts of competent jurisdiction.
15. Service Changes
We may modify, suspend, or discontinue any part of the Service at any time. We'll make reasonable efforts to notify users of significant changes in advance.
16. Changes to These Terms
We may update these Terms. For material changes:
- We'll email registered users at least 30 days before changes take effect.
- We'll post a prominent notice on the Service.
- The "Last Updated" date above will change.
Continued use after changes take effect means you accept the updated Terms. If you disagree, stop using the Service and delete your account.
17. General Provisions
- Severability — If any provision is found invalid, the rest stays in effect.
- No Waiver — Our failure to enforce a provision isn't a waiver of that right.
- Assignment — You can't assign these Terms. We can assign them in connection with a merger, acquisition, or asset sale.
- Entire Agreement — These Terms, our Privacy Policy, and our Cookie Policy are the complete agreement between you and SailScore.
18. Third-Party Services
The Service integrates with Stripe (payments), Supabase (data), Google (auth and translation), Twilio/SendGrid (verification and email), and various sailing governing body systems. Your use of those services is subject to their respective terms.
