Liability Waiver & Risk Acknowledgment

Important: Please read this document carefully before proceeding with your event registration.

Acknowledgment of Risk

By registering for this event, I acknowledge and accept the following:

1. Nature of the Sport

Sailing and yacht racing involve inherent risks that cannot be eliminated regardless of the care taken. These risks include, but are not limited to:

Environmental hazards -- changing weather conditions, high winds, rough seas, strong currents, tides, reduced visibility, lightning, and extreme temperatures.
Equipment-related risks -- rigging failure, hull damage, capsizing, collision with other vessels, fixed or floating objects, or submerged hazards.
Physical demands -- the sport requires significant physical exertion that may result in fatigue, injury, or medical emergency while on the water, potentially far from immediate shore-based assistance.

2. Personal Responsibility

I understand that:

The decision to participate is mine alone. Rule 3 of the Racing Rules of Sailing states: "The responsibility for a boat's decision to participate in a race or to continue racing is hers alone." Neither the organizing authority, the race committee, the protest committee, the host club, nor the event sponsors has any obligation to determine the suitability of conditions for racing or the fitness of any vessel or competitor.
I am responsible for the seaworthiness of my vessel, the adequacy of its equipment, and the competence and fitness of my crew.
I am responsible for my own safety and the safety of my crew while afloat, whether racing or not.
Safety equipment must be carried and operational as required by the Notice of Race and Sailing Instructions for this event.

3. Release and Waiver

To the fullest extent permitted by applicable law:

I release, waive, and discharge the event organizers, host yacht club(s), race committee members, protest committee members, event sponsors, Yacht Scoring (the platform provider), and their respective officers, directors, employees, volunteers, and agents from any and all liability for personal injury, property damage, or death that may occur as a result of my participation in this event, including travel to and from the event.
I agree that this release extends to claims arising from the negligence of the released parties, but does not extend to claims arising from their gross negligence or willful misconduct.
I agree to indemnify and hold harmless the released parties from any claims, lawsuits, or demands brought by me, my crew, or any third party arising out of my participation.

4. Medical Fitness

I confirm that I am physically fit to participate in this event and am not aware of any medical condition that would make my participation inadvisable. I consent to receiving emergency medical treatment if I am unable to communicate my wishes during an emergency on the water.

5. Insurance

I confirm that my vessel carries adequate third-party liability insurance for the waters and activities involved in this event, as required by the Notice of Race.

6. Data & Results

I acknowledge that my name, sail number, boat name, and race results will be published as part of the event's public record, consistent with the standard practices of competitive sailing.

By indicating your agreement below, you confirm that you have read, understand, and voluntarily accept the risks and terms described in this Liability Waiver & Risk Acknowledgment.
